Post Conviction Writs

After an appeal of a conviction has been exhausted, the next avenue is preparing and arguing a Writ of Habeas Corpus. A state writ is also called an 11.07 writ; a Federal Writ of Haeas Corpus is also referred to as a 2255 or 2254 writ.

These writs are used to attack the conviction on various grounds not covered in the original appeal. Many times this involves a claim of Ineffective Assistance of Counsel. I like to tell clients that an Appeal Is to grade the paper of the DA or the Judge; a writ is to grade the paper of the defense attorney who tried the case.
